1. Acceptance of Terms

Welcome to UserScanner ("we," "us," or "our"). By accessing, browsing, or using our website, scanning engine, API, and associated dashboard services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (these "Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Service.

2. Description of Service & Eligibility

UserScanner provides an Open Source Intelligence (OSINT) username and email verification search tool that aggregates publicly accessible information across various third-party web platforms.

To use this Service, you must be at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to enter into a binding contract. By using the Service, you represent and warrant that you meet these requirements.

3. Permitted and Prohibited Use Case Guidelines

The Service is intended strictly for security researchers, system administrators, forensic analysts, and individuals auditing their own public digital footprint or verifying the public profile exposure of targets with prior authorization.

You explicitly agree NOT to use the Service to:

• Harass, stalk, threaten, defame, or cause distress or harm to any individual or entity.
• Conduct unauthorized surveillance, intelligence gathering, or cyber-reconnaissance on individuals without their explicit, documented consent.
• Violate any local, national, or international laws, regulations, or third-party rights.
• Attempt to bypass, disable, or reverse-engineer the Service's rate limits, database check limits, or authentication protocols.
• Automate queries using scrapers, bots, or custom scripts outside our officially documented enterprise API frameworks.

We reserve the right, in our sole discretion, to monitor usage patterns, investigate alleged violations, and immediately suspend or terminate access for any user violating these guidelines.

4. Credit-Based System & Financial Terms

Access to our scanning modules is metered via digital "Credits." Guest and registered accounts receive complimentary credits upon creation. Additional credits can be purchased securely.

• No Monetary Value: Credits represent a limited, non-transferable license to execute scans on our platform. They possess no cash value and cannot be redeemed, refunded, or exchanged for real currency.
• Secure Payments: Credit purchases are processed by our authorized payment gateway, Razorpay. We do not store or handle credit card, bank, or payment details directly on our servers.
• Refund Policy: All purchases of Credits are final, non-refundable, and non-reversible, except as strictly required under applicable local consumer protection laws.

5. Intellectual Property & Third-Party Platforms

All intellectual property rights, code, algorithms, UI design, logos, and trademarks related to UserScanner are the exclusive property of UserScanner.

The Service queries public profiles hosted on third-party websites. UserScanner does not claim ownership, affiliation, or endorsement of any third-party brands, logos, or platforms checked. All trademarks appearing in scan results remain the property of their respective owners.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USERSCANNER DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or free from errors, or that the aggregated OSINT results will be 100% accurate, complete, or up-to-date. Third-party sites frequently change their access layouts, which may cause certain scanning modules to fail, experience false positives, or return obsolete information.

7. Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL USERSCANNER, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

You agree to indemnify, defend, and hold harmless UserScanner and its creators from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including WAF blocks or regional data privacy laws.

8. Governing Law & Dispute Resolution

These Terms shall be governed by, and construed in accordance with, the laws of India, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the competent courts located in India.

9. Modifications to Terms and Service

We reserve the right to revise or modify these Terms at any time. Any changes will be posted on this page with an updated "Effective Date." Your continued use of the Service following the posting of modifications constitutes your acceptance of the updated Terms.
